1 - Identity of the seller

These conditions are intended for a consumer who has full legal capacity. These conditions apply to all orders you place on this site.
All orders on the site are subject to these general conditions of sale. These are likely to be subject to modifications and updates, the conditions applicable to the order of a product by a customer are those in force on the day of the order. These general conditions of sale are subject to French law.
These terms of sale govern the sales made by The Little French Store and specify the conditions for ordering, payment, delivery and management of any returns of products ordered by customers.
The general conditions of sale are made available to customers on the site where they can be consulted.
The general conditions of sale are opposable to the customer who reads them before the implementation of the order procedure.
The Little French Store reserves the right to modify its Terms of Sale at any time. In case of modification of the Terms of Sale, the applicable Terms of Sale are those in force on the date of validation of the order. It is therefore up to the customer to refer to it during each order validation.
2 - Products
Each product offered on the site is accompanied by one or more photographs, a descriptive text, the metal used and the colors, this information is not contractual. The descriptions and photographs of the products sold on the site are as accurate and as faithful to reality as possible. However, the colors, dimensions, textures and other characteristics of the products may be altered by the screens or internet browsers used to view them.
The customer thus acknowledges that the photographs, descriptions or graphics accompanying and illustrating the products offered for sale on the site are indicative and not contractual and cannot engage the responsibility of the seller in the event of error, omission or modification. However, The Little French Store is committed to ensuring that the photographic representation of the products on the site is as faithful as possible to the product.
3 - The customer
The customer of the site must be a consumer, an adult natural person and legally capable. The customer must, when placing his first order on the site, complete an order form specifying certain mandatory fields so that his order of products can be taken into account by The Little French Store.
The information communicated to The Little French Store during each of its orders must be complete, accurate and up-to-date. The Little French Store may, if necessary, ask the customer to confirm - by any means - this information and his identity.
Given the commercial policy described above, The Little French Store reserves the right not to respond to orders from subjects that differ from the "consumer" or to orders that do not comply with its commercial policy.
4 - Ordering methods
Order taking on the site is subject to compliance with the procedure set up by The Little French Store on the site comprising successive stages leading to the order and the conclusion of the sales contract:
- Fill your virtual basket,
- Indicate the quantities, the model(s) of the product that you wishes to receive,
- Fill in the information relating to the delivery of the order,
- Select a payment method,
- Fill in the information relating to the selected payment method.
The customer can select as many products as he wishes, these will be added to the basket. The basket summarizes the products chosen by the customer as well as the prices and related costs. The customer can freely modify the basket before confirming his order.
The validation of the order constitutes an irrevocable acceptance which can only be called into question within the limits provided for by these terms of sale. It automatically entails the acceptance of the products purchased, their price, the associated costs as well as the general conditions of sale by the customer. The validation of the order concludes the sales contract.
In order to place an order, the customer undertakes to communicate via the site only the real and valid information necessary for the performance of the service covered by these terms of sale. The seller cannot be held responsible for erroneous information transmitted by the customer resulting in the non-performance of the service covered by these GCS.
Any order will be deemed validated only after acceptance of payment. The seller will be entitled to refuse or cancel any order relating to a customer in dispute on a previous order.
A confirmation email summarizing the order (product(s), price, quantity, etc.) will be sent to the customer by The Little French Store. To this end, the customer formally accepts the use of e-mail for confirmation by The Little French Store of the content of his order.
5 - Price and terms of payment
- Price :
The prices displayed on the site are expressed in euros, all french taxes included (French VAT and other french taxes applicable on the day of the order). Packaging and order processing costs are included in the price. For an order amount ranging from €0.00 to €49.90, shipping costs are payable. The shipping costs are indicated before the validation of the order.
The seller may modify the prices of the products at any time and without notice, in particular due to changes in the economic, legislative and tax framework. The products are invoiced on the basis of the tariff in force at the validation of the order. The telecommunications costs necessary to access the seller's website are the responsibility of the customer.
The products remain the property of the seller until full payment of the price.
- Payment terms :
Payment by card
The customer can pay by credit card. Cards issued by banks domiciled outside France must be international bank cards (Visa, Mastercard or American Express).
We use Shopify Payment as a secure payment solution to process transactions on our site. Shopify Payment adheres to the highest security standards in the industry and protects your personal and banking data. We do not store your payment information on our site and we are not responsible for any incidents related to the use of Shopify Payment.
Secure online payment by credit card is made by our payment provider Shopify Payments, which complies with the PCI (Payment Card Industry) data security standard and supports 3D Secure payments. Bank details are collected by Shopify Payments and encrypted using SSL, Secure Socket Layer technologies. It will therefore not circulate unencrypted on the Internet. The Little French Store does not keep your payment information under any circumstances and we are not responsible for any incidents related to the use of Shopify Payment.
Once the payment has been validated by the customer, the transaction is immediately debited after verification of the information. In accordance with article L. 132-2 of the Monetary and Financial Code, the commitment to pay given by card is irrevocable. By communicating his banking information during the sale, the customer authorizes the seller to debit his card for the amount relating to the price indicated. The customer confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it. In the event of an error, or the impossibility of debiting the card, the sale is immediately resolved as of right and the order cancelled. If applicable, an order cancellation notification for non-payment is sent to the customer by The Little French Store to the email address provided by the customer when ordering.
Payment via PayPal
The customer can make the payment via the PayPal platform.
With PayPal, your financial information is never communicated to The Little French Store. Indeed, PayPal encrypts and protects your card number. Pay online by simply entering your email address and password.
6 - Deliveries
In accordance with the provisions of Article L 121-20-3 of the Consumer Code, the products ordered are delivered within the deadlines indicated on the site and during the confirmation of the order, and within a period of approximately 5 to 7 days from the order.
The times indicated on the site and during the confirmation of the order are only indicative and correspond to the average time of processing and delivery of the package.
However, during busy periods such as Christmas, The Little French Store reserves the right to extend the shipping time.
In the event that the package is damaged on delivery, the customer must check the status of the products in his order and report any reservations in the event of a missing or damaged item.
No delivery can be made to a hotel or PO Box address.
From the dispatch of the order, the average delivery times are as follows:
- For France :
2 to 5 working days (by letter with follow-up).
- For Europe and internationally:
3 to 7 working days (by letter with follow-up).
It is specified that any change of delivery address made by the customer after the registration of the order may result in an extension of the delivery time.
The Little French Store and the carriers being separate and independent entities, The Little French Store cannot be held responsible for any delay and error in delivery or loss of parcels attributable to the Post Office.
If you request delivery outside of France, your order may be subject to any taxes and customs duties when it arrives at its destination.
The payment of these duties and taxes is your responsibility and we invite you to inquire with the competent authorities of your country. You also have to check the possibilities of importing the products you order from us into the country of destination.
7- Right of withdrawal and terms of reimbursement
No item can be exchanged or refunded except in the case where the product is non-compliant or has a hidden defect making it unfit for use. The customer then has a right of withdrawal of 30 clear days from the day of receipt of his order to return one or more items by justifying the reason making it unfit for use.
The returned product(s) must be in the initial state of sale, not having been worn or used or having been the subject of any use whatsoever and in their original packaging. Otherwise the shipment will be returned. The customer organizes the return at his convenience, at his expense and at his risk to the address indicated by the seller.
The shipping costs related to the return of the products remain the responsibility of the customer as well as any customs costs related to the return of the product from a foreign country.
It is strongly recommended to contact The Little French Store beforehand and to return the products with a follow-up even if it is possible to choose the carrier of your choice. It is therefore advisable to provide proof of this return, which assumes that the products are actually returned with parcel tracking, or by any other means giving a certain date.
Upon receipt, and subject to these return conditions, the seller will refund the order excluding the initial shipping costs by crediting the customer's bank account within 15 days of receipt of the package by the seller.
Failure to comply with these return conditions, the shipment will be returned to the customer at his expense and will not result in any refund.
Are excluded from any warranty:
- Improper use and maintenance as well as defects in use or maintenance.
- Damage due to handling error, abusive or abnormal use, intentional or accidental physical modification, use for professional or commercial purposes.
- Deterioration due to an external event (lightning, water damage, exposure to high heat
etc.).
- The interventions carried out on the jewel by any person not mandated by our after-sales service as well as the deteriorations resulting from such an intervention.
The refund will be made by bank transfer to the card used to pay the initial invoice. It is not possible to replace or exchange returned products. You will need to place a new order online.
As part of the free shipping, the amount of these costs will be deducted in the event of a refund.
8 - Warranties
The products benefit from the legal guarantee of conformity as well as the legal guarantee against hidden defects. Abnormal or non-compliant use of the products, as well as the consequences of such use or of external causes are excluded from the scope of the contractual guarantees.
For access to the site as well as for all stages of the purchase process, from ordering to shipping as well as subsequent services, the seller has only an obligation of means and cannot be held liable for all the inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses or any case of force majeure.

In accordance with the Data Protection Act of January 6, 1978, you have the right to access, delete, rectify and oppose personal data concerning you. The customer acknowledges that The Little French Store products and distinctive signs (image, photographs, packaging, product names, etc.) are the exclusive property of The Little French Store.
The customer is prohibited from any act of reproduction or use of product models, packaging, brands or distinctive signs, inventions, techniques or know-how used by The Little French Store, as well as any act tending to the appropriation of these elements, whether or not they are protected by The Little French Store by a patent, trademark, registered design and model or copyright.
10 - Applicable law, language and disputes
These General Conditions and accepted orders are subject to French law.
The language of these Terms of sales and of the accepted orders is the French language.
We also offer an English and German version of our site. An English version and a German version of the general conditions of sale are available there.
In the event of a dispute, national law and European law provide for the intervention of a consumer mediator in order to try to find an out-of-court solution to this dispute.
In accordance with Articles L.616-1 and R.616-1 of the Consumer Code, our company has set up a consumer mediation system. The chosen mediation entity is:
CNPM - MEDIATION - CONSUMPTION.

In the event of a dispute not resolved by the consumer mediator, the French courts will have sole jurisdiction.
11 - Terms of archiving and access to the contract
We will archive contracts, purchase orders and invoices on a reliable and durable medium. You have a right of communication to these documents for orders of an amount greater than or equal to €120.
